The article examines the mechanism of a judge expulsion with regard to the principle of independence of a judge during the performance of the impartial administration of justice. In the first point, attention was drawn to the reasons for the exclusion of a judge, followed to the conclusion that the expulsion is a subject to a judge against whom there is a justified suspicion of bias. The next point showcases the procedure of excluding a judge from adjudicating in a trial, with a particular emphasis on the authority competent to resolve an incidental case for excluding a judge. In the last point, the research was carried out on the consequences of accepting the act to disqualify a judge. The first outcome is a change of a judge, not the nature of the proceedings; and the second result is a validation of the procedural steps taken before and after the application for the request of a judge removal. The author raises a number of questions as well as offers some clarifications for the legislator on the mechanism of a judge's expulsion.
