Rozwój europejskiego ruchu stowarzyszeń sędziów społecznych

Abstrakt

Artykuł rozpoczyna analiza udziału obywateli w sprawowaniu wymiaru sprawiedliwości jako podstawowej zasady demokratycznego państwa prawa i podstawowego prawa politycznego obywateli. Po czym przedstawione zostały cztery fazy rozwoju stowarzyszeń sędziów społecznych w Europie (1920–2022), a następnie historia powstania i rozwoju European Network of Associations of Lay Judges (ENALJ) w latach 2012–2022, a także podstawowe cele i aktywności podejmowane przez to stowarzyszenie. W kolejnej części artykułu zaprezentowane zostały dwa wybrane postulaty formułowane przez środowisko sędziów społecznych w Europie: udziału jednego przedstawiciela sędziów społecznych w krajowych radach sądownictwa oraz reformy systemu szkolenia sędziów społecznych. Każdy z postulatów został odniesiony do kontekstu polskiego wymiaru sprawiedliwości. W podsumowaniu analizie poddano współpracę europejskich stowarzyszeń sędziów społecznych w kontekście wyzwań, zagrożeń, ale i oczekiwań, jakie przed nią stoją.
