Judicial Controversy Over the Meaning of the Term Noogenic Immaturity

Abstract

The subject of the Author’s attention in the presented study became the issue of the meaning of the new term noogenous immaturity, which appeared in unpublished several more recent rotal judgments. After examining seven rotal judgements, he pointed out that at present in rotal judicature it does not yet have a permanent consistency. He showed that, in the current state of knowledge, it refers to a system of values; moreover, according to the auditors (Erlebach), this immaturity is not autonomous, as it is considered a form of psychoaffective immaturity.

According to the Author, the existing difficulties in defining the meaning of this term are mainly connected to the reception of Victor Frankl’s thought into the area of canonical matrimonial law. In his opinion, this process has not been completed yet, because the accumulating difficulties are connected with working out the canonical concept of noogenic immaturity.
