In the recent case law of the Supreme Court, several interesting statements can be observed on the interpretation of Article 4(1) of the Act of 6 November 2008 on Patients‘ Rights and Patients’ Ombudsman (Journal of Laws 2024, item 581). They have a direct
bearing on the practice of judicial pursuit of claims for monetary compensation for medical errors (medical malpractice). Hence, in view of the recognition of the importance of the Supreme Court’s jurisprudential activity in ensuring the uniformity of the common courts‘ jurisprudence, this review will discuss the jurisprudence from 2019 to 2024 concerning the issue of the common courts’ awarding of compensation (redress) for violation of patients’ rights or for personal injury.
