The Right of the Child to Upbringing by Father and Mother

Abstract

The subject of this analysis is a right of the child to upbringing by father and mother. The Convention on the Rights of the Child recommends to take into consideration the best interest of the child in all actions concerning children (Art. 3, sect. 1). Therefore, the best interest of the child is a natural imperative of care for a dependant and immature individual and this imperative as such constitutes an essential value. In order to assure a full and harmonious development of its personality the child should be brought up in family environment, atmosphere of happiness, love and understanding. For the child’s development the distinction between masculinity and femininity is crucial because such a distinction makes part of natural order and is a biological, physical, spiritual, psychological and social reality. Thus, the Convention provides the grounds to formulate the right of the child to both parents, i.e. to experience their care, to have a personal, and emotional relation with father and mother. The sustainable development of personality of the child extensively depends on the parents and other persons bringing up the child. At each stage of the child’s development both parents participate in creation of emotions and feelings, each parent in its own appropriate way, a man (father) as a man, a woman (mother) as a woman. This intimacy with parents constitutes a strong ground for the child’s sense of security in its surrounding environment. The supporting participation of parents in the process of creation of a person in its identity and personality as a man or a woman constitutes as well an invitation for development of masculinity or femininity of their children. The understanding of the world, internal life and relations are diverse and depend on the harmony and compliance created by masculinity and femininity. Growing-up with father and mother permits the children to discover themselves within their own history which is related to the great history of nations and mankind to which each of us belongs.
